Welcome to the CalenQ Site. By using it, you are agreeing to these Terms of Service. Please read them carefully because they contain terms that may affect your legal rights.
CalenQ owns and operates the website and any mobile versions or sites we have now or in the future that reference these Terms of Service.
IF YOU DO NOT AGREE TO THE TERMS OF SERVICE, IMMEDIATELY STOP ACCESSING OR USING THE SITE AND/OR SERVICES.
CalenQ reserves the right, at our sole discretion, to change, modify, or otherwise alter these Terms of Service at any time. This right to unilaterally modify the terms applies uniformly to all users and across all types of licenses, including, but not limited to, Free tiers, Monthly Subscriptions, Annual Subscriptions, and Lifetime Deals.
All changes are effective immediately when we post them, and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms of Service means that you accept and agree to the changes.
The term "Lifetime" refers to the operational lifespan of the CalenQ software product, not the lifetime of the purchaser.
We are committed to constantly improving the software; however, we reserve the right to modify, transition, or eventually retire specific features, or the service as a whole, if they become technologically obsolete or commercially unviable.
In the unlikely event of a complete discontinuation of the core service, CalenQ will provide users with a minimum of 60 days' prior written notice to allow sufficient time for transition and data export.
By using the Site and accepting these Terms of Service, CalenQ grants you a limited, personal, nontransferable, nonexclusive revocable license to use the Site. Your license is subject to the following anti-abuse safeguards:
While Lifetime Deals require only a one-time payment for the core software, any future recurring subscription services (e.g., "Add-on" packs, SMS usage, or Enterprise tiers) are subject to renewal fees.
For recurring subscriptions, CalenQ reserves the right to increase renewal fees at the start of each billing cycle by up to the Consumer Price Index (CPI) plus 3%, unless we notify you of a different rate before the renewal term starts.
The CalenQ service is provided strictly on a "best-effort" basis without a guaranteed Service Level Agreement (SLA).
From time to time, CalenQ may introduce "Beta" or Artificial Intelligence (AI) features. You acknowledge that:
We will never sell your information to third-party marketers.
If you are a user located in the European Economic Area (EEA), the United Kingdom, or California, you agree that you are the "Data Controller" and CalenQ is the "Data Processor."
By using this service, you agree to our standard Data Processing Addendum (DPA), which governs the secure handling of your calendar data in compliance with GDPR and CCPA. See our Privacy Policy for full details.
You acknowledge that your account is personal to you and agree not to provide any other person with access to this Site using your username or password. We have the right to disable any username or password at any time in our sole discretion if, in our opinion, you have violated any provision of these Terms of Service.
AS PERMITTED BY APPLICABLE LAW, YOU EXPRESSLY AGREE THAT YOUR USE OF THE SITE, ITS CONTENT, AND ANY SERVICES OR PRODUCTS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT, AND ANY SERVICES OR PRODUCTS OBTAINED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
AS PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CALENQ, ITS AFFILIATES, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOSS OF PROFITS, OR LOSS OF DATA.
IN NO EVENT WILL CALENQ'S TOTAL LIABILITY IN CONNECTION WITH THE PRODUCT EXCEED THE AMOUNTS PAID BY YOU FOR THE APPLICABLE PRODUCT IN THE 12 MONTHS PRECEDING THE CLAIM.
All matters relating to the Site and these Terms of Service and any dispute or claim arising therefrom shall be governed by and construed in accordance with the internal laws of India. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Service or the Site shall be instituted exclusively in the courts of New Delhi, India. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
At CalenQ's sole discretion, it may require You to submit any disputes arising from the use of these Terms of Service or the Website to final and binding arbitration. The arbitration shall be conducted in New Delhi, India, in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted on an individual basis, and you expressly waive any right to participate in a class-action lawsuit.
The Services are defined as "commercial computer software" and "commercially off-the-shelf (COTS) items".
If you are using the Services on behalf of a government entity (U.S., India, or otherwise), you acknowledge that CalenQ provides these Services to end users solely with the same rights, limitations, and restrictions as are granted to all other private commercial users pursuant to the terms and conditions herein. We expressly reject any government-specific procurement terms or regulations unless agreed to in a separate, written custom enterprise agreement.
CalenQ offers a 60-day refund policy for purchases. If you are unsatisfied with your subscription for any reason, you may request a refund directly through your account settings within 60 days of your purchase for a full refund.
Beyond this 60-day window, the Lifetime Deal fee is strictly non-refundable.
If your access to CalenQ is provided on a complimentary or free basis, including a free trial, a coupon-granted plan, or an account credit, the following terms apply in addition to the above. All product features remain identical to paid plans; only these service terms differ.
